FUNCTIONS OF THE GENERAL DIRECTORATE
In accordance with the provisions of Article 8 of Decree 1742/2020, the following are the functions of the General Directorate:
1. To issue the general guidelines necessary to execute the powers and functions referred to in Article 1 of this Decree.
2. To issue general guidelines on tax, customs, foreign trade, and exchange control matters within the DIAN's jurisdiction.
3. To define policies related to achieving the organization's strategic objectives, particularly those related to engagement with the public or customer service.
4. To issue general guidelines and establish policies regarding carried out intelligence activities to prevent and fight tax evasion, smuggling, foreign exchange violations, and administrative corruption within the Agency.
5. To establish a specialized team of DIAN officials after judicial police functions are assigned, in accordance with the provisions of Article 203 of the Code of Criminal Procedure and in coordination with the Attorney General's Office.
6. To establish guidelines regarding tax and customs penalty procedures, as well as matters related to transferring case files to the competent authority.
7. To act as the competent authority and establish guidelines, as well as approve procedures for advance pricing agreements, in accordance with the provisions of the Tax Code.
8. To sign international agreements on tax, customs, and foreign exchange matters, in accordance with the guidelines of the President of the Republic and in coordination with the Ministry of Foreign Affairs and Ministry of Finance and Public Credit, as well as other relevant government agencies.
9. To act as the competent authority for exchanging tax information between the DIAN and other countries and international organizations.
10. To act as the competent authority and establish guidelines, authorize procedures to prevent and solve disputes within the framework of international tax agreements, and perform all functions related to the Mutual Agreement Procedure, in accordance with the provisions of Article 869-3 of the Tax Code and the regulations that govern, amend, supplement, or replace it.
11. To participate in developing policies related to taxation, customs, and foreign trade, and in preparing government proposals in these areas.
12. To issue guidelines for DIAN employees to participate in international activities to which the Agency has been invited.
13. To provide guidelines for promoting cooperation with national and international external agencies in programs aimed at fighting corruption and tax and customs crimes, as well as those that may arise from foreign exchange audits.
14. To submit and defend the annual action plan to fight tax evasion and smuggling before the Joint Committee on Tax and Customs Administration, and call the committee to convene when deemed necessary.
15. To oversee the process of exchanging experts, studies, non-reimbursable financial assistance, grants, scholarships, internships, seminars, courses, and workshops within the DIAN's purview.
16. To authorize the supervision of visits by the DIAN in exercising its tax, customs, and foreign exchange competencies, in order to verify the consistency and quality of the investigations and audits carried out by the Agency.
17. To determine the amount of, recognize, and pay rewards and incentives, whether in cash or in kind, for effective cooperation by third parties in fighting smuggling, tax evasion, and corruption.
18. To implement, maintain, and improve the Integrated Institutional Management System.
19. To issue guidelines and monitor the organization's plans, programs, and projects.
20. To issue general guidelines on matters related to planning, management, organization, supervision, control, reporting, and institutional communication.
21. To adopt the institutional management model to achieve the DIAN's objectives and the processes for its implementation.
22. To issue the guidelines for the organization's digital transformation and the intelligent use of data.
23. To appoint and remove DIAN officials and allocate positions within the permanent staff, with the exception of those positions for which another authority has the authority to make appointments.
24. To oversee personnel management according to the relevant regulations.
25. To establish general policies and guidelines regarding the disciplinary system and ensure measures are implemented to prevent and fight administrative corruption within the DIAN.
26. To determine the jurisdiction and organize the Regional Offices functionally, as provided in this Decree.
27. To solve jurisdiction conflicts that arise between the central and local offices of the DIAN.
28. To authorize the exchanging of information between the Regional Offices and public and private entities, in accordance with applicable regulations.
29. To issue guidelines for cases in which the feasibility of incentives for taxpayers in the form of tax rewards, such as raffles, contests, and other similar initiatives, is determined.
30. To enter into agreements and contracts and authorize the expenditures, payments, and budget transfers required by the DIAN, in accordance with applicable regulations.
31. To order the execution and management of physical and financial resources and approve the Entity's financial statements.
32. To establish policies for entering into agreements and other payment arrangements, and for the timely fulfillment of the obligations arising from them.
33. Set the prices to be charged for the sale of goods and services, as well as for additional services.
34. To authorize financial institutions to collect the taxes administered by the DIAN and enter into the necessary agreements.
35. To order the suspension of time limits in ongoing administrative proceedings, when circumstances require it, in accordance with applicable laws.
36. To oversee the DIAN's communications and corporate relations policies.
37. To create the necessary committees to guide, advise, define and determine the technical criteria required for the proper performance of tax, customs, and foreign exchange functions, and appoint their members and functions.
38. To establish internal control policies, design and implement the system, and ensure the development of its constituent elements.
39. To serve as the technical and administrative head of the DIAN and as the immediate administrative supervisor of the Directorates and Regional Directorates.
40. To perform all other functions assigned to it, in accordance with the Constitution and the law.
