Petitions, Complaints, Suggestions, Claims, and Reports (PQSRD)

Rights to petition under Law 1755 of 2015 and personal data processing under Law 1581 of 2012. Exceptions: If your request is related to appeals, revocation proceedings, guardianship cases, or other proceedings that follow special legal procedures, it will not be processed through the PQSR system.

Please note

The System for Petitions, Complaints, Suggestions, and Claims (PQSR, for the Spanish original) is the online channel the DIAN has set up on its website. This system allows submitting petitions according to Law 1755 of 2015, as well as inquiries and complaints related to the right to access personal data, in accordance with Law 1581 of 2012.

Through this service, users may file their requests respectfully, which will be handled in accordance with the guidelines established by the DIAN in Resolution 17 of March 26, 2018.

Please keep these points in mind when filing your request:

1. SUBJECT: The matters within the DIAN's jurisdiction are Tax, Customs, and Foreign Exchange.

2. THE FOLLOWING MATTERS ARE NOT HANDLED IN THE PQSR SYSTEM:

  • Appeals.

  • Revocations of guardianship.

  • Proceedings subject to special legal procedures.

  • Closing refund cases.

  • Deposits of funds from refunds.

  • Notification of the decision to accept or reject a refund request.

  • Exceptions to payment orders.

  • Terms and conditions.

  • Responses to ordinary requests (letters or DIAN information requests) or special requests.

  • Statements of charges.

  • Submitting evidence.

  • Payment agreements.

  • Terminations by mutual agreement.

  • Reconciliations.

  • Requests for an administrative decision of approval.                                                  

  • Requests from state entities with less than 5 days to respond.    

  • Law V – Requests made by congress, the senate and the house of representatives.

  • Opposition Party Act (Law 1909 of 2018) – Statute on the Political Opposition and Certain Rights of Independent Political Organizations.

  • Guardianship cases.

We invite you to check if your request refers to a specific procedure. To this end, the DIAN has set up service counters at all of its regional offices nationwide and at its central office, as well as authorized institutional mailboxes.

Note: Please remember that you must provide your personal information and attach a photocopy of your ID when submitting a request or complaint regarding personal data. Therefore, you will not be able to select the “anonymous user" option.

FOLLOW-UP: If you have already submitted a PQRS, do not resubmit it. Wait for a response or check the status using your case number in the PQRS system.

Tax, Customs, and Foreign Exchange Reports

General Information

Dear User, you can find a link to the Tax Compliance Complaint Information System on the DIAN's website, where you can file a report regarding alleged non-compliance with obligations related to tax, customs, and foreign exchange matters. Please note that by entering your information, you consent to processing of the provided data, which will be protected according to the provisions of Law 1581 of 2012 and Decree 1377 of 2013 (in other words, your data will be processed with absolute confidentiality to protect your identity).

Please remember that the information regarding the alleged events must be accurate and detailed, specifying the time, manner, and place.

Attach any evidence you may have about them to support your complaint. Enter the data of the person reported, such as:  ID, name or business name, and address.

Keep in mind that each report is a right to petition under Article 23 of the Political Constitution and will be addressed in accordance with the guidelines set forth in Resolution 17 of March 26, 2018, Law 1755 of 2015, or any regulations that amend, supplement, or replace them. Therefore, you will receive an immediate response to your report.

The investigation of the reports resulting from the reported facts shall be confidential.

Please keep these points in mind when submitting your report:

1. The matters reported that fall under the jurisdiction of the DIAN's Tax Audit Division include income tax, sales tax, withholding tax, wealth tax, smuggling, and foreign exchange control at the national level, as well as other matters specified in the tax, customs, and foreign exchange laws and their related regulations.

2. In the unlikely event you encounter any difficulty filing your tax compliance report through this channel, the Entity has established service counters at all regional offices and at the central office, as well as authorized institutional mailboxes and hotlines.

Important information:

  • Before submitting your tax compliance report, please make sure all the information you have entered is correct.

  • Do not file the same tax compliance report based on the same facts multiple times in the system, as subsequent reports will have no greater effect than the first one.
